Les présentes Conditions Générales d'Utilisation (ci-après "CGU") ont pour objet de définir les modalités et conditions d'utilisation de l'application mobile Ember Read (ci-après "l'Application"), éditée par la société KAIOSA SAS.
L'Application est une liseuse numérique permettant la lecture de livres électroniques avec synchronisation de retours haptiques via des appareils Bluetooth compatibles.
L'accès et l'utilisation de l'Application sont subordonnés à l'acceptation et au respect des présentes CGU.
En téléchargeant, installant ou utilisant l'Application, l'utilisateur reconnaît avoir pris connaissance des présentes CGU et les accepter sans réserve. Si vous n'acceptez pas ces conditions, vous ne devez pas utiliser l'Application.
L'Application est strictement réservée aux personnes majeures (18 ans et plus).
En utilisant l'Application, vous certifiez :

L'Application propose une version gratuite avec des fonctionnalités limitées et des abonnements payants.
Les paiements sont effectués via le site emberread.com et traités par Stripe, prestataire de paiement sécurisé. L'éditeur n'a pas accès aux coordonnées bancaires complètes.
Les abonnements sont renouvelés automatiquement sauf résiliation par l'utilisateur avant la date d'échéance.
L'utilisateur s'engage à :
L'Application, son code source, son interface, ses graphismes, ses textes et tous les éléments qui la composent sont la propriété exclusive de KAIOSA SAS et sont protégés par les lois françaises et internationales relatives à la propriété intellectuelle.
Toute reproduction, représentation, modification ou exploitation non autorisée est interdite et constitue une contrefaçon passible de sanctions pénales.
L'utilisateur est seul responsable des contenus qu'il importe dans l'Application. Il certifie :
KAIOSA SAS ne peut être tenue responsable des contenus importés par les utilisateurs.
L'Application permet la connexion à des appareils Bluetooth compatibles. L'utilisateur :
Le traitement des données personnelles est décrit dans notre Politique de Confidentialité, conformément au Règlement Général sur la Protection des Données (RGPD).
KAIOSA SAS ne garantit pas que l'Application fonctionnera sans interruption ni erreur. L'éditeur ne pourra être tenu responsable :
En tout état de cause, la responsabilité de KAIOSA SAS est limitée au montant des sommes effectivement payées par l'utilisateur au cours des 12 derniers mois.
KAIOSA SAS se réserve le droit de suspendre ou résilier l'accès à l'Application en cas de :
KAIOSA SAS se réserve le droit de modifier les présentes CGU à tout moment. Les modifications entrent en vigueur dès leur publication dans l'Application ou sur le site.
L'utilisateur sera informé des modifications substantielles. La poursuite de l'utilisation de l'Application après modification vaut acceptation des nouvelles CGU.
Les présentes CGU sont soumises au droit français.
En cas de litige, les parties s'efforceront de trouver une solution amiable. À défaut, les tribunaux compétents de Versailles seront seuls compétents.
Si l'une des clauses des présentes CGU était déclarée nulle ou inapplicable, les autres clauses resteraient en vigueur.
Le fait pour KAIOSA SAS de ne pas exercer un droit prévu aux présentes ne constitue pas une renonciation à ce droit.

These Terms of Use (hereinafter "Terms") define the terms and conditions for using the Ember Read mobile application (hereinafter "the Application"), published by KAIOSA SAS.
The Application is a digital reader enabling the reading of e-books with haptic feedback synchronization via compatible Bluetooth devices.
Access to and use of the Application are subject to acceptance of and compliance with these Terms.
By downloading, installing or using the Application, the user acknowledges having read these Terms and accepts them without reservation. If you do not accept these conditions, you must not use the Application.
The Application is strictly reserved for adults (18 years and older).
By using the Application, you certify that:
The Application is provided "as is", without warranty of any kind, express or implied.

The Application offers a free version with limited features and paid subscriptions.
Payments are made via the website emberread.com and processed by Stripe, a secure payment provider. The publisher does not have access to full banking details.
Subscriptions are automatically renewed unless cancelled by the user before the renewal date.

The Application, its source code, interface, graphics, texts and all its components are the exclusive property of KAIOSA SAS and are protected by French and international intellectual property laws.
Any unauthorized reproduction, representation, modification or exploitation is prohibited and constitutes infringement subject to criminal penalties.
The user is solely responsible for the content they import into the Application. They certify that they:

The Application allows connection to compatible Bluetooth devices. The user:
The processing of personal data is described in our Privacy Policy, in accordance with the General Data Protection Regulation (GDPR).
KAIOSA SAS does not guarantee that the Application will operate without interruption or error. The publisher shall not be held liable for:
In any event, the liability of KAIOSA SAS is limited to the amounts actually paid by the user during the preceding 12 months.
KAIOSA SAS reserves the right to suspend or terminate access to the Application in the event of:
KAIOSA SAS reserves the right to modify these Terms at any time. Changes take effect upon publication in the Application or on the website.
The user will be informed of any substantial changes. Continued use of the Application after modification constitutes acceptance of the new Terms.
These Terms are governed by French law.
In the event of a dispute, the parties shall endeavor to reach an amicable settlement. Failing that, the competent courts of Versailles, France, shall have exclusive jurisdiction.
If any provision of these Terms is declared null or unenforceable, the remaining provisions shall remain in force.
The failure of KAIOSA SAS to exercise any right provided herein shall not constitute a waiver of that right.
