Ember Read Application

Article 1 - Purpose

These General Terms of Use (hereinafter "GTU") are intended to define the terms and conditions for the use of the mobile application Ember Read (hereinafter "the Application"), published by the company KAIOSA SAS.

The Application is a digital e-reader allowing the reading of electronic books with synchronization of haptic feedback via compatible Bluetooth devices.

Article 2 - Acceptance of Terms and Conditions

Access to and use of the Application are subject to the acceptance of and compliance with these TOS.

By downloading, installing, or using the Application, the user acknowledges having read these TOS and accepts them without reservation. If you do not accept these terms, you must not use the Application.

Article 3 - Access to the Application

The Application is strictly reserved for adults (18 years and older).

By using the Application, you certify:

• To be at least 18 years old or of legal age of majority in your country of residence
• To have the legal capacity to enter into a contract
• Not being in a country where the use of this type of application would be prohibited

The Application is provided "as is", without warranty of any kind, express or implied.

Article 4 - Description of Services

The Application offers the following functionalities:

• Importing and reading e-books in EPUB format
• Bluetooth connection with compatible wellness devices (Satisfyer, Lovense)
• Vibration synchronization with textual content
• Varied control modes (manual, patterns, motion, music)
• Customization of the reading interface

Article 5 - Registration and User Account

Certain features may require the creation of a user account. The user agrees to:

• Provide accurate and up-to-date information
• Maintain the confidentiality of one's login credentials
• Immediately notify any unauthorized use of their account
• To be responsible for any activity carried out from one's account

Article 6 - Credits, Subscriptions and Immersion

The Application offers an immersion feature (haptic synchronization with textual content). Access to immersion must be unlocked individually for each book, according to the following terms:

6.1 - Methods of access to immersion

• Credits: The user may purchase credits to unlock immersion on a book. A book unlocked by credits is permanently acquired, regardless of subscription status.
• Premium Subscription (Stripe or Apple): The subscription allows unlocking immersion on all books in the library without using credits, as long as the subscription is active.
• Free Premium Trial: A free 30-day trial may be offered. It provides access to the same features as the Premium subscription for its duration.

6.2 - Expiration of the subscription or trial

Upon expiration of the Premium subscription or the free trial:

• Books unlocked with credits remain permanently accessible for immersion.
• Books unlocked during the free trial or subscription (without using credits) are no longer accessible for immersion. The user may permanently unlock them by using credits.
• Reading books (without immersion) is not affected by subscription expiration.

6.3 - Subscription Renewal

The subscription to a new Premium subscription (trial, Stripe or Apple) restores access to immersion for all books in the library, including those previously unlocked during a trial or prior subscription.

6.4 - Imported books (personal ePubs)

Books imported by the user from their own files are subject to the same immersion access rules as books from the catalogue: unlocking via credits or an active Premium subscription is required.

6.5 - Payments

Payments are made via the website emberread.com (Stripe) or through in-app purchases on the App Store (Apple). The publisher does not have access to full banking details.

Subscriptions are automatically renewed unless terminated by the user before the expiration date.

Article 7 - User Obligations

The user undertakes to:

• Use the Application in accordance with its intended purpose and these TOS
• Do not attempt to circumvent technical protection measures
• Do not use the Application for illegal or unauthorized purposes
• Respect intellectual property rights
• Do not disseminate unlawful, offensive, or harmful content
• Do not attempt to decompile, disassemble, or reverse engineer the Application

Article 8 - Intellectual Property

The Application, its source code, its interface, its graphics, its texts and all the elements that compose it are the exclusive property of KAIOSA SAS and are protected by French and international intellectual property laws.

Any unauthorized reproduction, representation, modification, or exploitation is prohibited and constitutes an infringement liable to criminal penalties.

Article 9 - Copyright on Imported Content

The user shall be solely responsible for the content they upload to the Application. They certify:

• Holding the rights to use imported books
• Respect copyright and related rights
• Do not import pirated or illegally obtained content

KAIOSA SAS cannot be held liable for content uploaded by users.

Article 10 - Connected Devices

The Application allows connection to compatible Bluetooth devices. The user:

• Is solely responsible for the use of these devices
• Must comply with the manufacturer's safety instructions
• Acknowledges that KAIOSA SAS is not the manufacturer of these devices
• Accepts that KAIOSA SAS cannot be held liable for any damage resulting from their use

Article 11 - Personal Data

Personal data processing is described in our Privacy Policy, in accordance with the General Data Protection Regulation (GDPR).

Article 12 - Limitation of Liability

KAIOSA SAS does not warrant that the Application will function without interruption or error. The publisher shall not be held liable:

• Direct or indirect damages resulting from the use of the Application
• Malfunctions related to connected devices
• Regarding data loss
• User-imported content
• Service interruptions for maintenance or updates

In any event, the liability of KAIOSA SAS is limited to the amount of sums actually paid by the user during the last 12 months.

Article 13 - Suspension and Termination

KAIOSA SAS reserves the right to suspend or terminate access to the Application in the event of:

• Violation of these ToS
• Fraudulent or abusive use
• Infringement of third-party rights
• Non-payment of subscriptions

Article 14 - Modification of the TOS

KAIOSA SAS reserves the right to amend these TOS at any time. Amendments shall take effect upon their publication in the Application or on the website.

The user shall be informed of substantial modifications. Continued use of the Application following modification constitutes acceptance of the new TOS.

Article 15 - Governing Law and Jurisdiction

These TOS are governed by French law.

In the event of a dispute, the parties shall endeavor to reach an amicable settlement. Failing this, the competent courts of Versailles shall have exclusive jurisdiction.

Article 16 - Miscellaneous Provisions

If any of the clauses of these ToS were declared null or unenforceable, the other clauses would remain in force.

The failure of KAIOSA SAS to exercise a right provided for herein shall not constitute a waiver of such right.
